Terms and Conditions

These terms govern the use of ruwark.com. Each professional engagement is also governed by its specific proposal, service order, or contract.

Website owner

1. Identification and acceptance

https://ruwark.com is operated by Ruwark S.A.C., RUC 20613452436, with registered address at Juan Espinoza Medrano Lt. 5, Rosaspata, Cusco, Peru. By browsing the website or using its forms, you accept these terms to the extent applicable. If you disagree, do not use the website. Linked platforms may have additional terms.

2. Purpose and scope of the website

The website provides corporate and commercial information, technical content, and channels for requesting guidance, proposals, or employment consideration. Its general content is not, by itself, professional advice, a definitive diagnosis, a binding offer, an administrative authorization, or a guarantee that a specific project is feasible.

3. Ruwark services

Archaeology

Assessments, diagnostics, CIRA, PEA, PMAR, research, expert reports, monitoring, and other cultural heritage services.

Environmental services

Environmental instruments, permits, monitoring, compliance, waste, public participation, contingencies, and technical support.

Surveying and geospatial services

Surveys, photogrammetry, LiDAR, geodesy, digital drawings, cadastre, mapping, and territorial data processing.

Solutions and support

Digital tools, training, documentary support, and technical or administrative management related to contracted services.

4. Engagement, scope, and pricing

An engagement is formed only when the parties accept a proposal, service order, contract, or other confirmed document. That document defines scope, deliverables, exclusions, price, taxes, payment, schedule, and responsibilities. An initial quotation may change if the area, field conditions, available information, authority requirements, or requested scope changes. The specific contract prevails in case of conflict.

5. Schedules, permits, and authority decisions

Schedules are based on the known scope and may depend on site access, weather, client information, third parties, and public authority timelines. Ruwark performs its obligations with professional care but cannot guarantee permit approval, an absence of observations, or a decision date controlled by the Ministry of Culture, environmental authorities, local governments, or other entities. Estimates are confirmed for each engagement.

6. Client responsibilities

  • Provide complete, accurate, current, and lawfully obtained information.
  • Provide access, authorizations, coordination, and reasonable safety conditions for the work.
  • Review and approve documents, milestones, and deliverables in a timely manner.
  • Pay fees, expenses, and government charges according to the agreed arrangement.
  • Report scope, location, design, or schedule changes that may affect the service.
  • Do not use preliminary deliverables as final or approved versions.

7. Permitted use

Use the website lawfully and respectfully without affecting security or availability. Impersonation, false or malicious submissions, unauthorized access attempts, harmful code, abusive automation, bulk extraction, infringement of third-party rights, fraud, spam, and illegal activity are prohibited.

8. Intellectual property

The Ruwark brand, logos, design, text, graphics, photographs, videos, documents, methodologies, and other content belong to Ruwark or are used with permission. Legitimate viewing and link sharing are allowed. Reproduction, adaptation, distribution, commercial exploitation, or removal of attribution requires prior authorization except where the law provides otherwise. Ownership and licensing of service deliverables are defined in the relevant contract.

9. Technical information and limitation of liability

Ruwark seeks to maintain useful, current information, but general content may contain omissions or become outdated due to technical or legal change. Project decisions require a project-specific professional assessment. To the extent permitted by law, Ruwark is not liable for damage caused by website misuse, incorrect user information, third-party failures, or events outside its control. Mandatory rights and liabilities remain unaffected.

10. Third-party links and platforms

The website may link to WhatsApp, social networks, payment services, maps, technology platforms, authority websites, and other external services. Ruwark does not control their availability, content, security, or policies. Access is at the user’s responsibility and subject to the third party’s terms. A link does not endorse all activity or content on the linked site.

11. Privacy and communications

Data submitted through forms or digital channels is processed under Ruwark’s Privacy Policy. Submitting an inquiry authorizes communications necessary to respond; it is not indefinite authorization for advertising. Marketing preferences and consent can be managed through [email protected].

12. Suspension and availability

We may update, restrict, or temporarily suspend website functions for maintenance, security, technical failures, legal requirements, or improvements. We may block uses that breach these terms or place users, infrastructure, or third parties at risk. We seek to minimize interruptions but do not guarantee uninterrupted availability.

13. Complaints and support

Inquiries may be sent to [email protected] or made by phone at +51 910 842 546. Consumer complaints will be handled through the channels and Libro de Reclamaciones required by Peruvian law. A complaint does not prevent a user from contacting Indecopi or exercising other legal rights.

14. Changes

We may update these terms to reflect changes to the website, services, or law. The current version and update date will be published here. Changes will not retroactively alter existing contracts unless agreed by the parties or required by law.

15. Governing law and disputes

These terms are governed by the laws of the Republic of Peru. The parties will seek to resolve differences through direct, good-faith communication. Where applicable, users retain the right to contact Indecopi, use alternative mechanisms, or apply to a competent court under applicable rules. These terms do not waive mandatory rights.
